Filing Process for Your Relative Who Lives Outside the United States:

If your spouse, child, son, or daughter is outside the United States, the immigration application process is a 3-step process as follows:

Step 1: File Form I-130 with the USCIS in the United States (with some exceptions). After the I-130 is approved the petition will be sent to the National Visa Center (NVC) (with some exceptions).

Step 2: The approved I-130 petition is sent to the National Visa Center. Once the visa is available, Forms I-864, DS 260 and other supporting documents are processed by the NVC.

Step 3: The U.S. Embassy or consulate will provide notification, processing and interview information to the Applicant.

STEP 1:

Please contact our office for preparation and filing of the Form I-130 (Petition for Alien Relative). If there are any follow-up queries by the USCIS with regards to your case we will respond to that as well.

STEP 2:

Step 2: The approved I-130 petition is sent to the National Visa Center. Once the visa is available, Forms I-864, DS 260 and other supporting documents are processed by the NVC.

2.1 What to file with NVC

The National Visa Center (NVC) collects the following information and documents for Immigrant visa applications:

* Immigrant visa application forms
* Affidavit of Support forms
* Ensures all fees have been paid prior to the immigrant visa interview at a U.S. Embassy or Consulate outside the U.S.

Please contact our office for the preparation and filing of the forms and submitting of all supporting documents to the NVC.

2.2 Payment of Processing Fees

a) Online Payment.

At the appropriate time, the NVC will send the following fee invoices:

Affidavit of Support fee invoice will be sent to the petitioner; and
Immigrant Visa Processing fee invoice will be sent to the applicant or the applicants designated agent.
If an attorney is representing the applicant, the NVC will send both invoices to the attorney.

Both fees must be paid by one of these two options:

Preferred Online Payment
Alternative Payment by Mail
Do not send any payments directly to the NVC.

Fee payments to the National Visa Center (NVC) are made through the Consular Electronic Application Centers Immigrant Visa Invoice Payment Center.

b) Access your Information at the NVC.

You will need the following information from the fee letter that you received from the NVC:
    * Case Number
    * Invoice Identification Number (located at the top of the Fee Bill Invoice)

You will also need:
    * your banks routing number
    * your checking (or savings) account number

Note: If you pay from your checking account and need guidance on locating your account and bank routing numbers, check with your bank.

Click on the Online Fee Payment to go to the Immigrant Visa Invoice Payment Center. Online payments must come from a checking or savings account(s) held at a U.S. financial institution.

Payers who are unable to pay online must follow alternate payment instructions.

Note: If it is the applicants intention to adjust status with United States Citizenship and Immigration Services (USCIS), please contact the National Visa Center before taking further action or making any payment or call our office for assistance to determine if you are eligible for adjustment of status in the U.S. and the process that needs to be followed thereafter.

If you believe you may be eligible for a Provisional Unlawful Presence Waiver please contact our office to confirm eligibility, preparation and filing of the Waiver.

Next Steps After Fee Payment

After you have paid the required Affidavit of Support fee, petitioners should follow the detailed instructions in Establish Financial Support.

Then, after you have paid the required Immigrant Visa Processing fee, follow the detailed instructions in Submit Visa Application and Supporting Documents.
